These terms are an agreement between [COMPANY] ("Human Pass", "we") and the organization that creates a Human Pass dashboard account ("you"), for using Human Pass on your sites and apps. The person who accepts them confirms they may bind the organization. Our data processing agreement forms part of these terms.
Early access
Access is by invitation while we work closely with our first sites. The service, its interfaces and prices may change; we'll give you reasonable notice of changes that affect your integration.
What you get
When a person signs in to your site with Human Pass, you receive an ID for that person that is stable on your site (within one project) and different on every other site, and confirmation that the person verified a government ID and is unique in Human Pass. If your project is enabled for them and the person agrees, you may also receive whether they're 21 or over, and their ID's issuing country and state. You also get a status service telling you when an ID you hold is suspended, revoked, deleted, merged or rotated.
Your responsibilities
- Use Human Pass for its purpose: knowing that accounts are distinct, verified people. Don't try to identify people, link their IDs across projects or with other sites, or re-identify them from what you receive.
- Tell your users in your privacy policy that you use Human Pass, and what you receive from it.
- Act on status changes: check the status service regularly and handle suspended, revoked, deleted, merged and rotated IDs as documented.
- Keep your client credentials secret, and register only redirect addresses you control (in production, on domains you've verified).
- Follow the law that applies to you, including privacy, consumer and anti-discrimination law. Human Pass's attributes (for example "21 or over") are evidence, not a substitute for any checks the law requires of you.
- Don't misuse the service: no attempts to break it, overload it, get around its limits, or use it for unlawful purposes.
Fees
Using the sandbox is free. In production, fees are as shown in your dashboard or agreed with us in writing, billed through Stripe. During early access we may waive fees. We'll give you at least 30 days' notice of fee changes.
Accuracy
We work hard to make verification and uniqueness accurate, and keep improving them, but no identity check is perfect: a real person can be refused, one person with documents from two countries can occasionally hold two Human Passes, and a determined fraudster could get through. Don't rely on Human Pass as your only safeguard for anything where an error would cause serious harm.
Suspension and termination
You can stop using Human Pass and close your organization at any time. We can suspend or end your access if you breach these terms, if your use puts people or the service at risk, or if the law requires it; where reasonable, we'll warn you first and give you time to fix the problem. People's Human Passes aren't affected.
Confidentiality and security
Each of us keeps the other's non-public information confidential. We protect the service as described in our security and privacy overview; report security problems to [SECURITY EMAIL].
Disclaimers and liability
The service is provided "as is" during early access, without warranties beyond those in these terms. To the extent the law allows, neither of us is liable for indirect or consequential losses or lost profits, and each party's total liability is limited to the fees you paid us in the 12 months before the claim (or [US$1,000] if greater). These limits don't apply to breaches of confidentiality, your misuse of the service, or liability that can't be limited by law.
Changes
We may update these terms. For changes that matter, your organization's owner is asked to accept the new version in the dashboard; we'll tell you what changed.
